www.bgs.vic.edu.au (the “Site”) offers an online payment service owned and operated by Ballarat Grammar (ABN 93 005 091 805) (“Ballarat Grammar”). Where you make a purchase through this Site, you are bound by the BALLARAT GRAMMAR Online Terms and Conditions of Sale in relation to that purchase.

Please read these Online Terms and Conditions of Sale carefully before using the Site. By using the BALLARAT GRAMMAR online payments service, you are agreeing to be bound by the following Terms and Conditions of Sale. If you choose not to be bound by the terms and conditions, BALLARAT GRAMMAR does not grant you the right to use the online payment service and you must not use this Site.

Online payments

Ballarat Grammar online payments may be made via credit card. Ballarat Grammar accepts Visa and Mastercard. Donations to the School are tax-deductible. None of the credit card details submitted by users are collected by the School. The Ballarat Grammar Privacy Policy will apply to all transactions and payments are subject to the Ballarat Grammar’s Refund Policy, as outlined in the Business Notice.

To make donation to more than one Fund, please select the ‘Restore Session’ link that becomes available on return to the purchase form. Your payee identification details will be restored but account details will need to be entered for each transaction.

Donation Payments are made subject to the following terms and conditions:

  1. Refunds: Refunds on purchases may be given upon written request to BALLARAT GRAMMAR by the purchaser. If a refund is made, BALLARAT GRAMMAR may retain any service or like fee it has charged. Requests for refund/s may be directed to [email protected]
  2. Event or Function Cancellations: Cancellations must be provided within 48 hours of the respective event or function to [email protected] A full refund will only be honoured and credited to the nominated credit card should cancellation be made 48 hours before the event or function. Refunds will not be honoured by BALLARAT GRAMMAR if cancellation is made less than 48 hours prior to the event or function.
  3. Admission: The right of admission to the event or function is reserved upon receipt of your payment and is subject to the Foundation’s terms of admission. Please retain your receipt as proof of purchase.
  4. GST: Prices in this Site include GST where applicable.

Policy Variation

BALLARAT GRAMMAR may vary these Terms at any time. Any variations become effective on posting. By making a purchase through this Site after the Terms and Conditions of Sale have been varied, you agree to be bound by the variation.

Use and Copyright

You may use the Site and the information contained within it for your own personal and non-commercial reference only. You agree that you will not hack into the Site nor employ any robot, spider or other device or process to use the Site for any unauthorised purposes. You agree that you will not take any action that imposes an unreasonably large burden on the Site.

The information contained within this Site (including programming scripts, graphics and logos) are copyright of BALLARAT GRAMMAR and its related bodies corporate. You may make any copies of any information reasonably incidental to your viewing of the Site and may retain a single permanent copy for your personal reference. Limitation of Liability

To the extent permitted by law our aggregate liability to you, whether for breach of these terms or in negligence or in any other tort or for any other common law or statutory cause of action arising in relation to these terms, the site or the content available through the site is limited to A$1,000. To the extent permitted by law we will not be liable for any direct, incidental, consequential or indirect damages, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your access to, or use of, or inability to use the Site and its content, whether based in contract, tort, negligence, statute or any other legal theory, and whether or not we know of the possibility of such damage. If a jurisdiction does not allow the exclusion or limitation of liability in accordance with the foregoing, but allows a limitation of a certain maximum extent then our liability is limited to that extent.

General Provisions

If any part of this agreement is held to be unenforceable, the unenforceable part must be given effect to the greatest extent possible and the remainder will remain in full force and effect. This agreement is governed by the laws of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria, Australia.
